Description of Matter Being Appealed: A notice of violation for failure to obtain Land Use and Engineering permits prior to installing approximately 15,000 square feet of concrete on the subject site. Additionally, failure to install a storm water treatment system in compliance with Federal Way Revised Code Sections 16.15 and 16.20. Scope of the Appeal/Summary of the Errors Alleged and Specific Factual Findings and Conditions Disputed in the Letter of Appeal: In its December 29, 2020, Appeal Letter on the Notice of Violation, the appellant, Plant 2 LLC, alleges that the City is stopped from requiring storm water improvements now associated with additional paving because it was Surface Water Management staff responsibility to inform the applicant of all permits and review required to resolve a Surface Water Management Water Quality Violation issued by them on January 6, 2020. The applicant further contends that on March 3, 2020 SWM issued a β€œclose-out” letter that was the final action that resolved all issues between the City and the Proponent as to the January 6, 2020 Water Quality Violation letter.
